Couple indicted over planting pot on son's teacher

A married couple accused of trying to frame an elementary school parent volunteer by planting marijuana and pills in her car have been indicted by an Orange County Grand Jury.

The couple, Kent Wycliffe Easter, 38, and Jill Bjorkholm Easter, 39, were indicted Thursday on charges of conspiracy to procure false arrest, false imprisonment and conspiracy to falsely report a crime, prosecutors said.

Prosecutors say the case dates to 2010, while the unidentified parent volunteer was at the school in Irvine, where Jill and Kent Easter?s son was a student.

The couple hatched the plot to retaliate against the teacher who they believe was not properly supervising their son, prosecutors said.

The couple is accused of planting a bag of Vicodin, Percocet, marijuana, and a used marijuana pipe behind the driver?s seat of the woman's unlocked vehicle and then calling police to report she was driving erratically and had drugs, the indictment said.

"(Kent Easter) is accused of telling the dispatcher that he was a concerned parent who had witnessed an erratic driver park at the elementary school," the Orange County District Attorney's Office said in a statement. "He is accused of claiming to have witnessed Jane Doe, whom he identified by name, hide a bag of drugs behind her driver?s seat in her car."

The Easters maintained cellphone contact and exchanged text messages during their plot, authorities alleged.

Jill Easter has written a novel?under the name Ava Bjork called "Holding House," about a mixed martial arts fighter hoping to strike it rich by undertaking a kidnapping, according to The Los Angeles Times.

If convicted, the defendants face a maximum sentence of three years in state prison.

Both are out of custody on $20,000 bail and are scheduled to be arraigned on Nov. 9.

MetroPCS reports Q3 2012 earnings, $193 million in net income

Net subscriber losses of 312,291 for the quarter brought the total subscriber count just under 9 million. Even with the net losses in customers, ARPU (Average Revenue Per User) remained flat at $40.50, but on a good note CPU (Cost Per User) dropped slightly to $18.38.

This quarter was a bit of a mixed bag for MetroPCS. We'll see how things shape up as the merger comes closer to completion in 2013.

Thousands gather at City Hall to celebrate Giants

SAN FRANCISCO (AP) - They came from all corners of the region and screamed louder with each strike and every out in the bottom of the 10th inning as the San Francisco Giants closed in on a second championship in three years Sunday.

The 2,000 fans assembled to watch the game on a Jumbotron a park across from City Hall grew in numbers and volume throughout the chilly and foggy night, exploding in unison with a roar with the final out.

Fans across the city left their televisions and raced into the streets, where they were greeted by diners and bar patrons who raced outside to celebrate as well. Car horns blared long into the night and revelers blocked traffic in front of popular watering holes around town.

At Polk and Bush streets in the city's Polk Gulch neighborhood, hundreds of fans sprayed champagne, set of off firecrackers and blocked traffic for at least two hours after the game.

Several blocks away, police clad in riot gear looked on as revelers danced around Civic Center plaza where they watched the game on the Jumbotron.

Anthony Yos, 10, hugged his brother Luciano Yos, 15 and the two danced in an embrace with their parents.

"This is the greatest thing," Anthony said with a smile that could go no wider. "The Giants are my favorite team."

Someone in the crowd launched fireworks a few minutes after the game and the park was awash with revelers, strangers hugging strangers and wine bottles and marijuana cigarettes being freely passed through the crowd despite a heavy police presence.

"This is San Francisco," said Laura Chu. "We know how to party."

Sara Vivas brought her 6-year-old daughter Briana Cepeda from Oakland to view the game and join the celebration. They were both clad head-to-toe in Giants garb.

"This is something she will remember forever," Sara said.

Bars of all stripes, from the Castro to Chinatown were packed with supporters of the beloved Giants.

So-called pedicabs whisked fans down roads blocked to traffic and revelers enjoyed a New Year's Eve-like freedom to roam up and down streets usually clogged with traffic.

Small fires broke out in trash cans here and there, but the violence and vandalism appeared to have been kept to a minimum a few hours after the last pitch.

Shortly before midnight, police said the street celebration was still going.

"We're watching out for any major flareups and fires," said police spokesman officer Carlos Manfredi. "We want to maintain public safety at all times, and don't want to put first responders in any danger."

He said police were responding to certain hot spots but had no reports of serious problems. No arrest figures were available.

Mayor Edwin Lee announced the ticker-tape parade would be held Wednesday at 11 a.m., down Market Street to Civic Center Plaza

"The rain in Detroit couldn't dampen the drive, talent and determination of the San Francisco Giants team tonight. Once again, the Giants brought our City together as we all cheered on our hometown heroes to another remarkable World Series victory," he said.

The 2010 parade drew hundreds of thousands fans, who lined the streets of downtown San Francisco. The parade ends at City Hall.

The party started early in Civic Center park, with many showing up hours before the 5 p.m. game on a nice Indian Summer day in San Francisco, wearing shorts and t-shirts. The blankets and sweaters came out when the sun went down and the fog rolled in, but the chill didn't damper the enthusiasm. Many in the crowd were carrying brooms in hope of the series sweep that came to be.

"We they were going to sweep," said Elizabeth Choy-Lau, 32, of San Francisco. She and her husband were carrying brooms.

"There was no doubt," said Steve Lau, 30.

The city's ubiquitous food trucks did a brisk business and drummers of all types beat their instruments throughout the game.

"Where else in the world do you want to be tonight," replied Dave Wormald of Toronto. Wormald and two other colleagues were in town for a business meeting and were watching the game at their hotel when they decided to embark for City Hall.

"This is the place to be," said Jim Vliet, Wormald's colleague.

Off-the-record interview goes public, Obama lays out 2nd-term goals

President Barack Obama laid out an astoundingly ambitious second-term agenda in an interview published Wednesday, vowing to forge a "grand bargain" with Republicans to reduce the national debt and achieve comprehensive immigration reform ? all in 2013.

"It will probably be messy. It won't be pleasant," Obama told the Des Moines Register's publisher and its editor by telephone. The daily made the exchange public after the White House dropped its insistence that it be off-the-record.

Messy? Unpleasant? Well, yes. Even if he wins reelection -- hardly a done deal -- few if any analysts expect the Democrats to retake the House of Representatives. And while Democrats are forecast to hold on to the Senate, betting that the president's party will secure a filibuster-proof 60-seat majority is a fool's game ? at least according to the latest polls. That makes these promises reliant on Obama using the 'bully pulpit' of the White House more effectively than he has since taking office January 2009.

"The good news is that there's going to be a forcing mechanism to deal with what is the central ideological argument in Washington right now, and that is: How much government do we have and how do we pay for it?" Obama said in the interview. He was referring to the so-called "fiscal cliff" at the end of 2012 ? the looming expiration of the Bush-era tax cuts, the painful automatic domestic and military spending cuts known as the "sequester," as well as the end of a temporary payroll tax reduction and some unemployment benefits.

The president has pushed for letting the Bush-era tax cuts (which he renewed entirely in late 2010 in the face of Republican pressure) expire for individuals making $200,000 or more or families pulling in $250,000 and above. Obama signaled that his longstanding offer for deficit- and debt-reduction will still be on the table, a move that could irk Democrats.

"I am absolutely confident that we can get what is the equivalent of the grand bargain that essentially I've been offering to the Republicans for a very long time, which is $2.50 worth of cuts for every dollar in spending, and work to reduce the costs of our health care programs," Obama said. (The White House quickly clarified that he meant $2.50 of spending cuts for every dollar in new tax revenue).

"We can easily meet ? 'easily' is the wrong word -- we can credibly meet the target that the Bowles-Simpson Commission established of $4 trillion in deficit reduction, and even more in the out-years, and we can stabilize our deficit-to-GDP ratio in a way that is really going to be a good foundation for long-term growth. Now, once we get that done, that takes a huge piece of business off the table.

"The second thing I'm confident we'll get done next year is immigration reform," said Obama, who has drawn fire from the Hispanic community for not keeping his 2008 campaign pledge to do just that. Republicans, meanwhile, have accused him of softening immigration enforcement for political gain.

"Since this is off the record, I will just be very blunt. Should I win a second term, a big reason I will win a second term is because the Republican nominee and the Republican Party have so alienated the fastest-growing demographic group in the country, the Latino community," he said. "And this is a relatively new phenomenon. George Bush and Karl Rove were smart enough to understand the changing nature of America. And so I am fairly confident that they're going to have a deep interest in getting that done. And I want to get it done because it's the right thing to do and I've cared about this ever since I ran back in 2008."

Republican opposition doomed immigration the last time around, and the political payoff is not always clear -- but senior Obama adviser David Plouffe told reporters Wednesday that the GOP could not afford to drive off Latino voters if the party hopes to survive.

"Republicans basically walked away from their belief that we need immigration reform. My suspicion is if you lose a presidential election to Latino voters by 40 points in a fastly (sic) growing country, the responsible thing to do if you're in that party that's losing by 40 points is to look in the mirror," Plouffe said.

Plouffe also said he thought he saw "more and more Republican senators ? saying they're more open to revenue" (meaning: tax increases). "And most Democrats have shown themselves open to do tough things on spending," he added. "It's going to require both parties coming together," Plouffe said.

Will Barca overlook Celtic?

A Champions League match in Russia means Tuesday will have an early kickoff, though with no points through two rounds, Spartak?s provided little more to the tournament than staggered start times. Their early match against Benfica isn?t technically a must win, but it?s difficult to see how Spartak get out of Group G with a loss.

The game in Moscow is the day?s opening act, with Barcelona-Celtic ? Group G?s other match ? part of the seven-match slate that kicks off at 2:45 p.m. Eastern.

  • Another was an embarrassing Champions League loss to Celtic, the game which looked like Spartak?s most likely victory when tournament groups were drawn.
  • This being Unai Emery?s first season as head coach, an early downturn naturally raises doubts about his fitness for the job.

That?s part of the reason Emery?s labeled Tuesday?s match as ?crucial,? though that status has as much to do with tournament implications as it does mounting pressure. Having lost their first two games of the competition, it may be now or never time for Spartak, particularly considering they?re facing Benfica (the team directly above them in the standings). Another home loss and every other Group G team will be (at least) four points ahead of Spartak.

Benfica have their own reasons for urgency, sitting on one point after two rounds. They failed to take advantage of a Celtic team that couldn?t manage a shot on target, and while nobody expected them to win their second match (against Barcelona), they remain without a win or a goal.

Coach Jorge Jesus doesn?t seem concerned. While, like Emery, he conceded the match was very important to Benfica?s chance to finish second (nobody?s even faking a chance of besting Barcelona), Jesus also hinted at a wait-and-see approach. He expects Spartak to play desperately and take chances. He?ll adjust his tactics accordingly.

Read between the lines, and we may again see a Benfica team that?s more concerned with the other team?s attack than their own. While that makes sense for a team on the road in Champions League, at some point Benfica is going to have to be more proactive. If they?re waiting for the right place and time, they could return to Lisbon in fourth in their group.

McCaskill canceled campaign stops Tuesday in Mount Vernon, Butler and Clinton. Legacki said she also canceled the rest of her get-out-the-vote tour in rural Missouri and all other campaign events through the end of the week.

Legacki said McCaskill and her siblings plan to be with their mother around-the-clock at the hospital and requested prayers and privacy.

Representing Sutter Health and Sutter Coast Hospital was Michael Duncheon and Michael McNaughton, who contended that this contract ?expired by its own terms 20 years ago.?

Health Care District attorney Michael Morrison argued that because both parties continued to abide by the lease?s terms without contesting them, that is ?strong circumstantial evidence that those agreements were intended to survive.?

?I have great difficulty with the idea that there?s a solid contract with both feet on the ground, but then again I?ve been persuaded this morning that there?s some likelihood the plaintiffs will prevail,? said LaCasse, citing the notion of an ?implied duty? of Sutter Health to maintain and operate an acute care facility in Del Norte County.

?The question is: Do they have to do that forever? And that?s a question I don?t have to answer,? he concluded.

?We are happy to get this preliminary injunction. I think arbitration in this case was not what we wanted, but it was what the original contract said. Since we?ve established now that the original contract is in effect, we have to follow it.?

Caldwell is a local physician, Health Care District representative and a former hospital board member who cast the sole vote against pursuing regionalization last November.??

Hospital spokesperson Beth Liles commented by email Wednesday afternoon:?

?We are disappointed with the ruling. Sutter Coast Hospital and Sutter Health continue to believe the District?s claims are without merit as they are based on a 1985 lease that expired by its own terms when Sutter Health built and opened the new hospital. We of course will abide by the terms of the preliminary injunction until the matter is resolved in arbitration.?

While an initial temporary restraining order in this case barred Sutter Health from downsizing or reorganizing any departments at the hospital, particularly billing, this provision was not included in Wednesday?s ruling.?

Hospital officials have said that the ?consolidation of support services? is already happening independently of regionalization. Last week Sutter Health announced the opening of a 1,000-employee center for administration in Roseville, which will ultimately reduce the number of employees at its 27 affiliated hospitals. The specific impact on Crescent City?s staffing hasn?t been announced.

Also, while Romney and his running mate Rep. Paul Ryan have no foreign policy experience, and that can be seen as a weakness in the GOP ticket, Obama has a mixed record to defend.

Washington Post foreign affairs columnist David Ignatius reports that initial CIA ?talking points,? provided by a senior US intelligence official, supported UN Ambassador Susan Rice?s early contention that the attack in Benghazi was tied to protests against the YouTube video.

Why Greg Smith left Goldman Sachs

Greg Smith wrote the essay that echoed across Wall Street like a thunderclap.

Smith was a vice president at Goldman Sachs until March. He announced his departure from the investment bank with a blistering essay in The New York Times, accusing Goldman of routinely deceiving clients and relentlessly pursuing profit at the expense of morality.

And he struck a nerve. The essay, on the Op-Ed page of The Times, went viral in the financial world and beyond. Smith was praised for uncloaking corruption that was crying out to be addressed, and also derided as a disgruntled employee.

Goldman Sachs denies Smith's allegations about deceiving clients. The bank says it took his concerns seriously, thoroughly investigated them, and found no evidence to support them.

Smith's book, "Why I Left Goldman Sachs," is being released Monday. It's a window into a company that is notoriously tight-lipped, with stories about a swaggering place where interns arise for 5 a.m. meetings and business trips mean slapping down $150 for one person's dinner.

What Smith hopes to do, he says, is educate people about how Wall Street works, and fuel a public conversation about what went wrong ethically, and how to fix it. The practices that caused the financial crisis, he says, were never really resolved; they're just lying dormant.

Smith, 33, gave his first text interview to The Associated Press. Excerpts have been edited for clarity and length.

Q: Tell us about March 14, the day you left Goldman. You were working in the London office, and you say you had already cleaned out your desk and had been told the essay would go online at 7 a.m. your time.

A: I get up at 6 a.m., and I type a very heartfelt email to nine people in Europe, including the CEO of Goldman Europe, and express in very personal terms why I'm leaving. I talk about exactly what I thought was wrong with the place, this obvious deceit of clients.

Within five minutes I get an email back from someone on the management committee in Europe who says, "I'm really surprised to hear this. I'm in London today. I'd love to meet with you." I get two voice mails from two other people. And then at 6:57 or 6:58, the piece comes online.

Q: What did the bank do?

A: My work BlackBerry stayed on for about three more hours, and I started getting emails from clients who were saying, "We completely agree with you, we don't trust Goldman Sachs, we do business with you guys with a 'buyer beware' attitude." I started getting text messages from Goldman managing directors who were supportive as well. And Goldman reached out to me in formal fashion and said, "We're sorry to hear you resigned; we'd like to air these concerns out."

Q: The bank denies everything you've charged about its ripping off clients.

A: The thing that disappoints me most is that management is denying there's a problem. Why not try to repair the trust instead? Clients are telling you they don't trust you. There's been an SEC fraud suit that was settled for half a billion dollars.

(The Securities and Exchange Commission accused the bank of selling investments to clients when the bank believed the investments were going to fail. Goldman paid $550 million. It remains the largest SEC penalty paid by a Wall Street firm.)

I'm not some lone voice who thought there was a problem, a change from a client fiduciary model (doing what's best for the client) to use-the-client-to-extract-wealth model. It's a problem that many, many of my colleagues felt and that the public feels as well, borne out in SEC suits and congressional testimonies and clients saying publicly that they don't trust us.

Q: Were you just disgruntled? Maybe you didn't get the bonus or the promotion you wanted?

A: I was actually doing well in my career at Goldman. My bonus, I was told I outperformed my peers by 10 percent. I'm a competitive person, and my goal was to get promoted, and I was told by multiple partners that I was two years away from getting promoted. So it certainly was a goal of mine. And on the compensation side, I was earning a lot of money and had a very good living, so I was grateful for what I was earning. It allowed me to have a good life and to support my family and to do things that I thought were valuable.

Q: But you were at Goldman for almost 12 years, if you start with your summer internship in 2000. Weren't there times when you should have stood up, should have said something about what you thought was morally wrong?

A: I actually made a conscious decision not to sell toxic deals to clients. I didn't think it was the right thing to do, but I also saw the idea that if clients' trust is being burned and they're getting blown up, you're not going to have a career for very long.

Now that does not mean I was not part of a system that was doing things that were unethical. In the book, I try to show some of the conflicts I noticed that gave me pause. For many years, I gave the firm the benefit of the doubt.

It absolutely could have happened quicker. But one can always see things earlier and sooner.

Q: OK, but isn't the purpose of any capitalist company to make money? You certainly made a lot of money at Goldman. (Smith says he made in the "high hundreds of thousands of dollars" in his best years but declines to be more specific. His publisher declines to say what he was paid for the book.)

A: Capitalism should be where everyone competes hard and makes money, in an environment where there is fair play and competitiveness. Right now the system is stacked against everyone else in favor of the banks.

It's a little like a casino. A real casino is regulated and there are cameras everywhere and the casino cannot see your cards. With Wall Street today, the bank can see what every government, every pension fund, every hedge fund in the world is doing. They can effectively see everyone's cards. Then, instead of facilitating the client's will, they're trying to get the client to facilitate their will.

Q: What do you hope to accomplish with your book?

A: People know there's this huge conflict, and that things are being done that are unethical but are not necessarily illegal. But nobody can put their finger on exactly what the problem is. My goal with the book was to write it to a general reader who knows nothing about finance. By the time someone reaches the end of the book, they can say, "I can now speak more intelligently about where the conflicts of interest are, and I can lobby my congressman or I can speak about it more." If people are not educated about what the issues are, they're powerless. That was the problem with Occupy Wall Street ? they didn't know what they were protesting.

Q: The banks are going to say any bad practices were caused by just a few bad actors, and that those guys are gone.

A: This is not some conspiracy of five people sitting in a room plotting to destroy the world. This is far more boring. This is where people have created a perverse incentive system.

If someone can overcharge a client by a million dollars, their leaders are going to say, "Great job, we just made an extra million dollars off this pension fund."

Q: So the endemic part is that people don't speak up?

A: People don't like being asked or compelled to make morally dubious decisions. But unfortunately a lot of people's livelihoods are tied up in this, and it's not an easy thing to unwind. Their lives are caught up in this system where they're sending their kids to private schools ? it's almost like the machine for them is working so well that there's no way to undo it unless you want to change your lifestyle.

Q: Why should we care about what happens on Wall Street?

A: You see a lot of commentary that Wall Street is just rich people gambling with other rich people's money. I want people to know that it ultimately affects everyone. In 2008, banks had to be bailed out and that hits taxpayers. If you're a teacher or a fireman or a charity, and you have an investment fund that is trading with Wall Street, and Wall Street is not being held accountable and behaving ethically, then that directly impacts everyone.

Q: What about the reaction of your family and friends to all this? You didn't tell them about the essay beforehand.

A: No, my mother would have been really upset, and frankly my mother is still very upset. She's mostly worried about how I don't have a job right now. For my parents' generation, the idea of stability is very important, while my generation is a little more idealistic about wanting to actually change things, even if it involves some kind of personal risk. It took me a while to show my mother that I was actually very proud of this.

New Orleans murder victim killed in Treme-Lafitte loved basketball ...

The family of a 21-year-old man who was shot and killed Friday in the Treme-Lafitte area was still reeling in shock Sunday. Christopher Lambert was a "family man" who loved to play basketball, said his aunt, Geraldine Lambert.

"The family is taking it very hard," the victim's aunt said. "He was just the type of person to keep you laughing. It's a shock the way he died."

Lambert was shot in the head about 4:45 p.m. inside of an abandoned house in the 2500 block of Orleans Avenue, said Officer Garry Flot, spokesman for the New Orleans Police Department. Police found his body inside the house.

Police are following up on several leads, and have not released a motive or suspect in the slaying,?as the case remains under investigation.

Lambert loved to spend time with his sister, two brothers and four kids, his aunt said. Both of Lambert's parents are dead.

"I can't believe he's gone, but, you know, he's with his mother and father right now so I'm satisfied with that," said Geraldine Lambert.

What inspired you to write this book?I wanted to start a series about a smart young professor who uses her linguistic knowledge to solve crimes. I thought also making her a Quaker would add depth and an unusual aspect to her character. And then I followed her around and wrote down what happened.What exciting story are you working on next? I'm writing the second book in the Local Foods Mystery series. It opens during a fall Farm-to-Table dinner, and I was lucky enough to attend one at a local farm just last week. Great food in a beautiful setting all in the name of research.When did you first consider yourself a writer? In about third grade. My mother told me I was a good writer and I guess it just stuck. I've written ever since in all kinds of formats - journalism, academic papers, technical documentation ? but fiction is what I love to write.Do you write full-time? If so, what's your work day like?? If not, what do you do other than write and how do you find time to write? Alas, I write technical documentation full time, so fiction gets fit in on weekends, retreats, plane rides, and so on. When I do have a full day available, I get up early and write until about lunchtime, when I usually run out of steam. Staying off the Internet is important on those days. It's hard to find enough time to write the books as well as network and promote, but so far I've managed. I hope to be able to leave the day job sometime in the next few years, though.What would you say is your interesting writing quirk? If you had a camera on me at my desk, you would see me doing all kinds of crazy physical things: figuring out logistics of being grabbed or of holding a weapon while also hanging on to something else; scaring myself so I can describe how the throat thickens and the heart thumps; making weird facial expressions, and more. I have to be careful when I'm out writing in a coffee shop or library!? As a child, what did you want to be when you grew up? I really don't remember. Isn't that strange? I know I aspired to be a teenager. I adored a girl who lived down the street, with her full-skirt dresses and cool shoes.
